Terms and Conditions

Terms and Conditions

1. I confirm that I am authorised to submit the material for publication on the Portal and that the submission is made in full compliance with all applicable legislation and/or policy.

2. I understand that the material I am submitting is intended to be made publicly available, and I confirm that the material contains no confidential information and that all necessary steps have been taken to protect intellectual property appropriately.

3. I confirm that, to the best of my knowledge, the material is accurate, does not violate any relevant legislation, and does not infringe upon the intellectual property rights of any third party.

4. I agree that I may not hold the Department of Science and Innovation and Department of Small Business Development, collectively be referred to as the Parties, liable for any breach in regard to clauses 1 to 3 above.

5. I provide consent to the Parties to edit and/or curate the material for the purpose of clarity, consistency and/or space. The Parties shall provide me with the opportunity to approve any amended copy. Failure to respond within two weeks of a written request for such approval shall be deemed as consent that the Parties may publish the material concerned.

6. I undertake to respond promptly to any requests from the Parties for further information, revision or clarification.

7. I authorise the Parties to use the material submitted for publication on the Portal and for reasonable related purposes, including (without limitation) on relevant social media platforms, for the sole purpose of promoting the Portal and the technologies listed there.

8. I acknowledge that the Parties may upload and/or remove information about the technology/technologies I submit at its sole discretion, and that the Parties has no obligation to notify me when my submitted material is uploaded or removed.

9. I acknowledge that the Parties may choose not to upload any material submitted.

10. Should I require any material that I have submitted to the Portal to be removed or amended, the Parties shall remove or amend the material concerned (as the case may be) within two weeks of receipt of a written request.

Conditions of use of the IBP

Any person (user) accessing this website is subject to, and agrees to, the terms and conditions set out in this legal notice. If the user does not wish to be bound by these terms and conditions, the user may not access, display, use or download and/or otherwise copy or distribute content obtained from this website.

 

1. Use and Copyright

1.1 Use of this portal and any services, content or applications contained herein or offered hereon is at the sole risk of the user.
1.2 Users may view, copy, download to a local drive, print and distribute the content of this portal, or any part thereof for non-commercial, informational or reference purposes only.
1.2.1 Users may not cede, sub-license or otherwise transfer any rights they may have under these terms and conditions or which may otherwise have been obtained through the use of this portal.

 

2. Disclaimers and Indemnities

2.1 The information on this portal is intended to provide general information on a particular subject or subjects and is not an exhaustive treatment of such subject(s).
2.2 It is the sole responsibility of the user to satisfy him or herself prior to accessing this portal that it will meet the user's individual requirements and be compatible with the user's hardware and/or software.
2.3 This entire portal, including text, images, links, downloads and coding, is provided "as is" and "as available". The Department of Science and Innovation and Department of Small Business Development, Republic of South Africa will collectively be referred to as the Parties, makes no representations or warranties, express or implied, including but not limited to warranties as to the correctness or suitability of either the website or the products, services or information contained in it.
2.4 The use of the content of this portal/website is at the user’s own risk.
2.4.1 The user assumes full responsibility and risk of loss resulting from the use of the content of this portal.
2.4.2 The Parties or any of the legal entities in respect of which information is contained on this portal, or employees of the Parties , will not be liable for any special, indirect, incidental, consequential, or punitive damages or any other damages whatsoever, whether in an action of contract, statute, delict (including, without limitation, negligence), or otherwise, relating to the use of this document or information.
2.4.3 Subject to sections 43(5) and 43(6) of the Electronic Communications and Transactions Act 25 of 2002 and to the fullest extent possible under law, Parties shall not be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use, or reasonable reliance upon this portal or the services or content provided from and through this portal.

3. Receipt and sending of data messages

3.1 Data messages, including e-mail messages, sent by users to the portal owner shall be deemed to be received only when acknowledged or responded to in writing.
3.2 Data messages sent by the portal owner to users shall be regarded as received when the complete data message enters an information system designated or used for that purpose by the recipient and is capable of being retrieved and processed by the recipient.
3.3 If a user does not receive a response within a reasonable period of time, the user should follow it up with the Innovation Bridge Portal Curator.

4. Security

4.1 The Parties has in place reasonable commercial standards of technology and operational security to protect all information provided by users from loss, misuse, alteration or destruction.

4.2 All reasonable steps will be taken to secure a user's information. Authorised employees, who are responsible for the maintenance of any sensitive data submitted, are required to maintain the confidentiality of such data. The policy applies to all employees of the Parties or public bodies that may receive such information from the Parties.

4.3 It is expressly prohibited for any person, business, or entity to gain or attempt to gain unauthorised access to any page on this portal, or to deliver or attempt to deliver any unauthorised, damaging or malicious code to this portal.

4.3.1 If a person delivers or attempts to deliver any unauthorised, damaging or malicious code to this website or attempts to gain unauthorised access to any page on this website, a criminal charge will be laid against that person, and, if the Parties or any public body should suffer any damage or loss, civil damages will be claimed.

5. Monitoring and interception of data messages

5.1 In order to provide a relevant and secure service, and when required to do so under law, the Parties may monitor and/or intercept electronic communications, such as e-mails, which are sent to and from this website.
5.2 To the full extent necessary under the law, the user hereby acknowledges that he or she is aware of such potential monitoring and/or interception and consents thereto.

6. Confidentiality of data messages

6.1 The Parties prefers not to receive confidential or proprietary information from users through this portal.
6.2 Please note that any information or material sent to the Innovation Bridge Portal will be deemed not to be confidential.
6.3 The portal will not release users’ names or otherwise publicise the fact that materials or other information has been submitted to it unless:
6.3.1.1 prior permission is obtained to use the user’s name; or
6.3.1.2 the user has first been notified that the materials or other information submitted to a particular part of this site will be published or otherwise used in a manner that reflects the user’s name; or
6.3.1.3 where required to do so by law.

7. Links to third party or external sites

7.1 The portal may provide links to other websites only as a convenience and the inclusion of any link does not imply the endorsement of such sites.
7.2 Linked websites or pages are not subject to the control of the portal.
7.3 The portal uses Google Analytics software from Google which is used to monitor how users interact with the website in order to improve its functionality and content. All data tracked by Google Analytics will remain confidential and inaccessible to other parties. We make use of Google analytics.js (Universal Analytics) which tracks only a user’s activities and no other personal information. This is to improve the user’s experience on the site.
7.4 This site is hosted by a provider that is within South African borders and is not cloud-based.

8. Intellectual property rights

8.1 All content, data and trademarks, including, but not limited to, software, technology, databases, know-how, text, graphics, icons, hyperlinks, private information, designs, programs, publications, products, processes, or ideas described in this website may be subject to other rights, including other intellectual property rights, which are the property of, or licensed to content sources on the portal.
8.2 Subject to the rights afforded to the user herein, all other rights to all intellectual property on this website is expressly reserved and by accessing data on this portal the user is not licensed or authorised.
8.3 Third party websites are welcome to link to the information that is hosted on these pages.

9. Automated searching

9.1 Automated transactions and searches are subject to these terms and conditions.
9.2 The use of malicious search technology is prohibited.
9.3 The use of search technology in an unlawful manner or for the collecting or harvesting of data for commercial gain is prohibited.
9.4 Search technology which does not unduly retard the operation of this website is acceptable but the portal owner reserves the right to prohibit any specific entity from employing search technology on the portal.

10. Applicable law

10.1 The user hereby agrees that the law applicable to these terms and conditions of use, their interpretation and any matter or litigation in connection therewith or arising from them will be the law of South Africa.
10.2 This portal is owned, hosted and maintained within the Republic of South Africa.
10.3 When using this site and agreeing to these Terms and Conditions such use and agreement is deemed to have taken place in Pretoria, South Africa.

11. General provisions

11.1 In the event of any part of these Terms and Conditions being found to be partially or fully unenforceable, for whatever reason, this shall not affect the application or enforceability of the remainder of this Agreement.
11.2 These Terms and Conditions of Use contain the record of the entire agreement between the user and the portal owner.
11.3 Failure to enforce any provision of these Terms and Conditions shall not be deemed a waiver of such provision nor of the right to enforce such provision.
11.4 The content owner or the Innovation Bridge Portal Curator has access to facilities to generate brochures that might include information uploaded to the related organisation.

12. Updating and maintenance of these Terms and Conditions of Use

12.1 The Parties reserves the right to modify, add to or remove portions or the whole of these Terms and Conditions of Use from time to time.
12.2 These Terms and Conditions of Use will take effect upon such being posted to this website.
12.3 It is the user’s obligation to periodically check these Terms and Conditions of Use on this website for updates.
12.4 The user’s continued use of this website following the posting of updates will be considered notice of the user’s acceptance to abide by and be bound by these Terms and Conditions of Use.

13. Subscriptions

13.1 Users may subscribe to multiple categories on the portal as a registered member on the portal. Members can manage their subscriptions from their Profiles. Alternatively, there is an Unsubscribe on the subscription mails.

14. Curator email interface

14.1 The curator will often communicate with the user on content related matters and information solicitation through surveys via well as share opportunities deemed relevant to them.

15. System Generated emails

15.1. The user will receive system-generated e-mails relating to updating of content, expiry of content as well as subscribed information alerts as per section 13.

17. Anonymous Contact Form

The Portal uses an anonymous contact for the purpose of sending inquiries to the information source/content owner.  The information provided on the form will only be visible to the intended recipient and will not be in a readable format in the server. The server will save a backup copy for up to 7 days, whereafter it will be permanently deleted.

Privacy Notice

1. Status, application, and amendment

1.1 This Privacy notice forms part of the legal notice and disclaimer of this portal/website and is incorporated into the legal notice and disclaimer.

1.2 This privacy notice applies to the Department of Science and Innovation and Department of Small Business Development, collectively be referred to as the Parties and any legal entity that controls, verifies or makes use of information that may be collected via this portal/website.

2. Collection of personal data

2.1 Where personal information (such as, but not limited to, the user’s name, telephone number and email address) is submitted to this portal/website by the user, for example through sending an email, subscribing to a service or filling in the required fields, the following principles are observed in the handling of that information:

(a) This portal/website collects, processes and stores only such personal information regarding users as is necessary to provide the services offered. The specific purpose for which information is collected is apparent from the context in which it is requested.

(b) This portal/website will not use the personal information submitted for any other purpose other than the efficient provision of services, including this portal/website and services offered through it by third parties, without obtaining the prior written approval of the user or unless required to do so by law.

(c) This portal/website will keep records of all personal information collected and the specific purpose for which it was collected for a period of at least one year from the date on which it was last used.

(d) This portal/website will not disclose any personal information regarding a user to any third party unless the prior written agreement of the user is obtained or the portal/website is required or permitted to do so by law.

(e) If any information is released with the user’s consent, this portal/website will retain a record of the information released, the third party to which it was released, the reason for the release and the date of release, for a period of one year.

(f) This portal/website will destroy or delete any personal information under its control that has become obsolete.

2.2 Note that, as permitted by the Electronic Communications and Transactions Act, 2002 (Act No. 25 of 2002) this website may use personal information collected to compile profiles for statistical purposes. It will not be possible to link any information contained in the profiles or statistics to any specific user.

3. Collection of anonymous data

3.1 Data messages, including email messages, sent by users to the portal/website owner: In order to provide the best possible and most relevant service, this portal/website may use standard technology such as cookies or web beacons to collect information about the use of this site. This technology is not able to identify individual users but simply allows this portal/website to collect statistics.

3.2 This portal/website uses session- or temporary cookies. A cookie is a small file that is placed on the user’s hard drive-in order to keep a record of a user’s interaction with this website. Session cookies are deleted once the user closes his or her browser.

3.3 Cookies from this portal/website allow the website owner to tailor services to the user’s displayed preferences.

3.4 Cookies by themselves cannot be used to personally identify users but will be used to compile anonymised statistics relating to the use of services offered or to provide feedback on the performance of this portal/website.

3.5 If a user does not wish cookies to be employed to customise his or her interaction with this portal/website, it is possible to alter the manner in which their browser handles cookies. Please note that, if this is done, certain services on this portal/website may not be available.

4. Access to personal data

4.1 If personal information has been submitted to this portal/website, users who wish to review their personal information may do so by logging into their account and choosing the “edit my profile” option. Users will then be able to access their user profile, correct and update their details, or e-mail the Curator to unsubscribe at any time.

4.2 Users who experience any issues accessing their profiles, or who would like to request a copy of their personal information, should contact the Webmaster using the feedback link. In all cases, the Department of Science and Innovation and Department of Small Business Development  will treat requests to access information in accordance with applicable legal requirements.

4.3 Emails and any other communication sent via the site sent to the user’s preferred email address and the communication will also be duplicated onto the User’s dashboard.

5. Links to other websites

The Department of Science and Innovation and Department of Small Business Development has no control over and accepts no responsibility for the privacy practices of any third-party sites to which hyperlinks may have been provided and we strongly recommend that you review the privacy policy of any site you visit before using it further.

6. No agreement

Nothing contained herein creates or is intended to create a contract or agreement between the Department of Science and Innovation and Department of Small Business Development  and any user visiting the portal/website.

8. Additional Information: How do we collect personal information?

With regard to the personal information we collect, we make use of a number of technologies that collect personal information automatically:

Cookies

Cookies are small files that are saved onto the user’s computer which track, save and store information about how the user uses this portal/website. In some instances, these cookies are needed for the portal/website to function – the user can disable them in their browser but this may interfere with the proper functioning of this portal/website.

Google Analytics

This is tracking software from Google which is used to monitor how users interact with the website in order to improve its functionality and content.

Web server Software

Web server software delivers web-pages to the user’s browser. The web-server software will automatically collect the user’s IP address whenever the user connects to the portal/website.

YouTube

This is software used to display videos. We do not collect personal information from the user by placing these videos on our site or through the user viewing them, but Google Inc. (which owns YouTube) collects personal information when videos are placed on webpages.

AddToAny

This is software that is used to place social media buttons on the website which allows users to share content on the website through social media. We do not collect personal information by placing these buttons on our site, but the AddToAny Company does.

Social Media Platforms and External Links

This portal/website may make use of social media platforms such as Facebook or LinkedIn. Whenever users make use of any such platforms on this portal/website, please note that any personal information users share on these platforms is subject to social media platforms' privacy policies and not the Innovation Bridge Portal's. This portal/website may also contain links to external websites. Whenever users click on a link and are taken to an external website, note that use of those websites is governed by their privacy policies and not that of the Innovation Bridge Portal.

9. Securing Users’ Information

We take care to protect users’ personal information using information security safeguards, however, users should be aware that no safeguards are 100% effective all of the time and it is, therefore, possible that their personal information may be accessed by unauthorised or unknown persons should these safeguards be defeated or fail.

10. Changes to this notice

This privacy notice may be amended from time to time. All amendments shall be posted on this portal/website. Unless stated otherwise, the current version will replace all previous versions of this notice. It is the user’s responsibility to check for changes each time they visit the portal/website.

Privacy Statement

Introduction:

  • The Innovation Bridge Portal and its custodians, the Department of Science Innovation (DSI) and Department of Small Business Development (DSBD) will collectively be referred to as the Parties.
  • This privacy statement will inform you what the Parties will do with the Personal or Special Personal Information it collects from you. It also indicates your rights as a data subject.

Application of this Privacy Statement:

  • This privacy statement will apply to the Parties and Personal or Special Personal Information supplied by you. It includes any processing or further processing of the Personal or Special Personal Information by any third-party partners or duly authorised government entities;
  • The Parties will require consent from data subjects to participate in the Portal, until such consent is provided, the Innovation Bridge Portal, its custodians and third party partners or government entity duly authorised will not have access to the Personal or Special Personal Information of the data subject.

Purpose for the collection:

  • Where Personal or Special Personal Information is submitted to the Innovation Bridge Portal by the data subject, for example through sending an email, subscribing to a service or filling in the required fields, the following principles are observed in the handling of that information:
    • The Innovation Bridge Portal collects, processes and stores only such Personal or Special Personal Information regarding users as is necessary to provide the services offered. The specific purpose for which information is collected is apparent from the context in which it is requested and can be summarised as follows.
      1. To enable the creation of user profiles on the Innovation Bridge Portal;
      2. To verify the identity of the person submitting information on the Innovation Bridge Portal
      3. To specifically tailor services provided by the Innovation Bridge Portal;
      4. To contact the data subject and attending to the data subject’s or the Innovation Bridge Portal’s enquiries and requests;
      5. For research and statistical analysis purposes, including data analysis;
    • The Innovation Bridge Portal will not use the  Personal or Special Personal Information submitted for any other purpose other than the efficient provision of services, including this services offered through it by third parties, without obtaining the prior written approval of the data subject or unless required to do so by law.

Implications of withholding consent

  • The Parties requires your  Personal or Special Personal Information for the purposes indicated above, and your explicit consent is mandatory to process the aforementioned Personal or Special Personal Information;
  •  Should you elect to withhold consent for the for the Parties to process your Personal or Special Personal Information, then the Parties will be unable to optimally service you and your needs.

Storage, retention and destruction of information

  • Your Personal or Special Personal Information will be stored either physically in the record storerooms or electronically in a centralised database, which, for operational reasons, will be accessible on a need to know and business basis. All Personal or Special Personal Information will be encrypted.
  • The Parties undertakes to conduct regular audits regarding the safety and security of your Personal or Special Personal Information;
  • Once the Personal or Special Personal Information is no longer required because the purpose for which it was held has expired, your Personal or Special Personal Information will be safely and securely archived for the requisite and prescribed retention periods as required by the law. On expiration of this retention period, the Parties will permanently destroy your Personal or Special Personal Information or send it to approved external storage facilities that are PoPIA compliant, as the case may be.

Access by others and cross border transfers

  • The Parties may have to disclose your  Personal or Special Personal Information to other duly authorised parties to either verify your Personal or Special Personal Information and or extent their beneficial services to you as the data subject. The Parties will always ensure that there is a legitimate reason for such disclosure and that your Personal or Special Personal Information is handled with strict confidentiality and data security conditions;
  • Your  Personal or Special Personal Information will not be transferred across the borders of South Africa.

Right to object and complaints

  • You are encouraged to make immediate contact with the Parties at any time if you are not comfortable or satisfied with the manner in which your Personal or Special Personal Information is being processed. On receipt of your objection, the Parties will place a hold on any further processing until the cause of the objection has been resolved. If you are still not satisfied with such process, you have the right to lodge a complaint with the Information Regulator at POPIAComplaints@inforegulator.org.za 

Accuracy of information and responsibility

  • PoPIA requires that all your Personal or Special Personal Information and related details, as supplied are complete, accurate and up-to-date. It will be your responsibility to advise the Innovation Bridge Portal of any changes to the Personal or Special Personal Information, as and when these may occur.

Access to the information by the Data Subject

  • You have the right at any time to ask the Parties to provide you with the details of the Personal or Special Personal Information which the Innovation Bridge Portal holds on your behalf; and/or the purpose for which it has been used, provided that such request is made using the standard Section 14 PAIA process, which can be accessed by downloading and completing the standard request for information form, housed under the Section 14 PAIA Manual which can be found on the Department of Science and Innovation website at www.dst.gov.za and the Department of Small business Development website www.dsbd.gov.za 

Declaration and informed consent

  • You confirm that the Personal or Special Personal Information, provided to the Innovation Bridge Portal is accurate, up-to-date, not misleading and is complete in all respects, save where same may change and then in such event, you undertake to advise the Innovation Bridge Portal of these changes.
  • In providing the required  Personal or Special Personal Information to the Innovation Bridge Portal, you consent and give the Innovation Bridge Portal permission to process and further process your  Personal or Special Personal Information as and where required and acknowledge that you understand the purposes for which the  Personal or Special Personal Information is required and for which it will be used.
